FluxPMS Terms of Service

1. Introduction

FluxPMS is provided by FluxSoft Technologies, LLC, a Delaware limited liability company ("FluxSoft", "we", "us"). By creating an account, you ("you") agree to these Terms of Service. If you're signing up on behalf of a hotel or company, you confirm you have authority to bind that business to these Terms.

If you don't agree to these Terms, don't create an account or use the Service.

2. The Service

FluxPMS is a cloud-based property management system (PMS) for hotels, hostels, and similar lodging businesses, provided as Software-as-a-Service. We grant you a limited, non-exclusive, non-transferable license to use it to run your hospitality business, for as long as your subscription is active.

3. Free period and signup

New accounts get 30 days free, starting the day you sign up. A payment card is collected at signup and held securely by Stripe — you are not charged during the 30 days. If you don't cancel before the 30 days end, your card is automatically charged for the plan you selected. You can cancel anytime, including during the free period, at no cost.

4. Subscription & billing

Current plans and prices are published at fluxpms.com/pricing and shown on the registration page — refer there rather than to a fixed table here, since pricing can change. When it does, we'll give at least 30 days' notice by email before it applies to your renewal.

  • Subscriptions bill in advance, monthly or annually, in US Dollars.
  • Fees are non-refundable except as stated here or as required by law.
  • Each plan has limits on rooms and properties; we may restrict creating new ones beyond your plan's limit.
  • If payment fails, we retry automatically for a few days, notify you by email, and suspend access if it continues to fail. We restore access as soon as payment succeeds.

5. Cancellation and refunds

You can cancel at any time, self-serve, from your account's billing settings (the Stripe-hosted billing portal linked from Settings → Subscription). Cancelling stops future billing; you keep access through the end of the period you already paid for. We don't offer prorated refunds for partial periods unless required by law.

6. Account responsibilities

The person who creates the account is the primary administrator and is responsible for activity under that account, for keeping login credentials confidential, and for the conduct of any staff they invite. Notify us immediately at [email protected] if you suspect unauthorized access.

7. Acceptable use

You agree not to:

  • Use the Service for anything illegal
  • Upload or transmit malware or harmful code
  • Try to gain unauthorized access to our systems or another tenant's data
  • Interfere with other users' access to the Service
  • Send spam or unsolicited bulk communications through the Service
  • Resell or redistribute the Service without our written agreement
  • Scrape or use automated tools against the Service without permission

We may suspend or terminate accounts that violate this section.

8. Your data

You own your hotel's operating data — bookings, guests, rates, and everything else you or your staff enter. We process it only to provide the Service and as described in our Privacy Policy. You're responsible for your own compliance with laws that apply to your hotel and its guest data (registration requirements, tax collection, applicable privacy law) — we support the technical side, but the legal obligations of running your hotel remain yours.

9. Service availability

We run FluxPMS to be reliably available and invest in keeping it that way, but we do not currently offer a contractual uptime guarantee or service-level credits. The Service is provided "as available." We're not liable for outages caused by third-party providers, internet connectivity issues, events outside our control, or your own equipment.

10. Third-party services

FluxPMS integrates with third-party services — Stripe for payments, and optionally channel managers or other tools you connect. Your use of those is governed by their own terms. We're not responsible for third-party service outages or actions.

11. Intellectual property

FluxPMS — the software, design, and "FluxPMS"/"FluxSoft" names and marks — belongs to FluxSoft Technologies, LLC. You may not copy, modify, or reverse-engineer it. If you send us feedback or suggestions, you give us permission to use them without owing you anything for it.

12. Disclaimer and limitation of liability

To the extent the law allows: the Service is provided "as is," without warranties of any kind, express or implied. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data. Our total liability to you for any claim is capped at the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow these limitations, in which case they apply to the fullest extent the law does allow.

13. Termination

You may cancel anytime as described in Section 5. We may suspend or terminate your account if you violate these Terms, engage in fraud or illegal activity, or if payment fails and stays unresolved. If we discontinue the Service entirely, we'll give at least 30 days' notice. On termination, your right to use the Service ends, and Sections 8, 11, and 12 survive.

14. Changes to these Terms

We may update these Terms. If a change is material, we'll notify account holders by email at least 30 days before it takes effect. Continuing to use FluxPMS after that means you accept the change; if you don't, you should cancel before it takes effect.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules.

Controlling language: This document is also published in other languages for convenience. If there is any conflict or inconsistency between translations, the English-language version controls.

These Terms work alongside our Privacy Policy. Together they're the agreement between you and FluxSoft Technologies, LLC for using FluxPMS.
